I've been inconvienced there plenty of times due to narrow isles at checkout. But I still shopped there and got what I wanted/went after.

So what, now all the gimps looking for $$$$ file an app. to collect, and up go our prices on everything in the store, again. great maybe ya'll can buy a new scooter w/ yer well deserved moolah. Buy the biggest scooter you can find though because the isles are widening for us!

*no insult intended toward you, Susan. This isn't meant to be personal. I don't know anything about your dis or how you manage.

It's really too bad businesses don't react to the ada until money is involved. I went to the local hospital for some lab work yesterday. They've spiffed it up a bit and added a waiting room for the lab. My chair wouldn't fit through the door. Too many years have gone by for basic things like that to still be ignored!

Having hit the wall so often that theres tracks in the bricks...
People who wonder how many little old ladies I have killed or left for dead in shopping isles.. and I am not saying..
I have only one way of driving this red devil and I don't care how narrow the friggin isles are they had better be wide enough for me. ..
or else I do damage... And I can look very innocent...............

I've shopped in many KMarts and never had a problem. There are always some wide check out isles to get through. I usually find a way and try not to be a pain in the ... about every little thing. This law suit is simply another nail in KMart's coffin. They're on their way out anyway from the way things look right now and this will simply hasten the final closing, also adding another notch to Walmart's belt. Too bad, as I do enjoy shopping there for certain items.

IMO, WalMart is the worst offender. Many of the aisles are impossible to get through, especially in the clothing sections. I never go there anymore unless as a last resort.

I was in our local store recently (under protest) and most of the aisles were blocked by pallets full of merchandise. There was room to walk through but it was impossible to get anywhere in my chair. I questioned one of their wage-slaves about it and he just said they were doing some seasonal change-over. He just gave a shrug and a blank stare when I asked him how someone in a chair was supposed to shop there under those conditions.

I've told people something that doesn't exactly endear myself to them, but that's tough.

Everyone is a hearbeat away from a disabling accident or illness. It happens every day. 24/7.

In a country where insurance (what a freakin' racket!) is so prevalent, you'd think people would want things already in place to accommodate them should they find themselves in our collective situation.

It's always the same. The dangerous intersection gets a stop light only after some kid is killed. Security is beefed up only after someone is raped or mugged in a parking lot. It goes on.

Unless it strikes close to home, our needs are waay over on the back burner. When they are addressed it's all talk and no walk.

I'm always amazed at what businesses and organizations have been able to get away with despite ADA. Interestingly I've been to small mom-and-pop type places (small restaraunt for example) where things weren't to ADA specs but it was obvious that at least they tried and the owners jump in to help, while large chain stores manage to not comply. I hate clothes shopping because, like others here have mentioned, the aisles in clothing departments are narrow, plus trying things on is made impossible because of inaccessable dressing rooms. When I can get into the stall in a dressing room, I encounter the same problem that occurs with "accessable" restrooms: barely enough room to wheel in, and no room to move around to change clothes. Basically someone thinking "accessable" is magically achieved by simply putting a handicapped logo on the door. Makes me wonder just what sort of disability they think they're accomodating by sticking the logo on a too-small stall? And the brains of the people working there simply sieze up when you point the problem out to them.

Now on the other hand, the local grocery store chain I shop at *does* seem to make sure things are accessable, and even when there is a problem, there are enough people working there to notice and step in to help. I don't have a car so I my friends help out so things out of reach aren't a huge problem.

In regards to ADA non-compliance in general, is it just me, or does some of the opposition to ADA and actions by PWDs to make things better actually come from other PWDs? I say this because I've seen in other forums and have heard in discussions when PWDs act as if things are made *worse* by ADA and those pushing to make sure people comply. The phrase "reasonable accomodation" being interpreted by some as "if you can't get your wheelchair in, tough sh**". I mean, when it comes to accessable public restrooms, it's as if since we're disabled, we're supposed to pretend that we're not bothered by the lack of privacy when we can get in but not close the stall!

Anyway, glad to see K-Mart made to pay for their failure to comply.

Just occurred to me- perhaps it's a case of the larger the business, the more they're able to get away with before anyone is able to say anything. I say this because the local TV news here in San Antonio loves to air expose' stories about which small eatery got busted for health code violations, but just once I'd like to a McDonald's or Booger King get written up.

I agree with you on the Wal-Mart not being accesible, especially the baby isle. I don't know how many times I have banged my wheelchair into displays trying to turn the corner to get to the baby wipes section or the sippy cup section. Its even worse when you bang into something and people glare at you, like its all your fault that the isles are too narrow.
I've also had trouble in their Supercenters when they are stocking shelves. The staff just looks at you when you ask them to move cases of food or that annoying crane-type device out of the way. The last time I was at the Wal Mart Supercenter, my Granny yelled up a storm at one staff person who was too busy chatting with a customer she knew to move a case of food out of the way so I could get by. Let's just say that I acted like I didn't know Granny for a minute becuase she was yelling so loud.

walmart, bealls, belks, umm almost any antique store, furniture stores, and my chair is only 25 inches wide...i just dont see where they can make EVERYTHING wide enough for chairs to go up and down without enlarging their already enlarged buildings. we'll shut down everything with lawsuits...jmo

How does making the contents of a store accessible shut them down? This is another misconception about the ADA. If the store (entity) can prove (it is very easy) that it would be a financial burden or would alter the main purpose of the entity, they do not have to make the accessibility changes by widening the isles. The bigger stores can't claim it would be a financial burden - removing one or two racks from a mega store will not shut them down. However, a little Mom & Pops store it might - so they don't have to make it accessible that way. They could possibly meet the accessibility requirements in another way - by bringing the merchandise to you for example.

BTW, it has been law for 14 years - do you personally know anyone who has been shut down because of an ADA lawsuit?

no, i dont. a friend of mine and his business partner remodled a restaurant here in town, 350K renovation. i helped make everything was ada compliant. i told one of his workers(INSTEAD OF DIRECTLY TELLING FRIEND) that they need a few low tables...well he never told my friend...he got popped for not having any low tables near dance floor.

now that u and susan said what u said the suit makes sense...

Our K-mart only has one wheelchair accessible check-out aisle. I get all my shopping done, go back to the electronics dept. pick up a small item like a battery, and check out all my items back there. They hate it and I don't care. They also have broken locks on all the dressing rooms. I complained enough to them over the years about the inaccessibility of their aisles and the dressing room. Our Wal-mart is huge and every check-out aisle is accessible. So unfortunately for K-mart, they are losing a lot of business.

K-Mart or Big K whatever it's being called these days is/was well on it's way out a few years ago. The merge with Sears has done nothing to improve any aspect, and what amazes me is that they are still in business. Service at either store is
abominable, and in this vicinity too checkouts are to narrow. Make sure you don't need the washroom while there also. Why do I still go there? Only if I cannot find what I am looking for elsewhere.
