My understanding is that if just one office in the facility (medical group, university hospital, research facility, etc) sends information electronically for any type of billing purposes, the entire facility is a "covered entity" - any subcontractors with the covered entity may or may not be under HIPPA .... BUT the covered entity is still responsible for ensuring the protection and privacies of patient information. If a subcontractor divulged confidential informtation, that subcontractor may not be subject to HIPPA penetilities but the covered entity would.
Am I wrong in that?
I have not dealt with a hospital or other medical entity that does not have a patient confidientiality policy clearly spelled out, especially now with HIPPA in place.

My point is, the HIPPA law does not apply to individuals records that are held within the Federal Government, those records are bound by the Privacy Act of 1974 5 U.S.C. § 552a . By definition of "private" sector I was speaking about public entities and health servicing companies as you mention above. I work as a Privacy Officer for a living. But I do think it is important for people to understand the difference between the two
