When my mailman comes today, I'm gonna ask him if he has had any instruction from USPS about parking in HC spaces......to be continued.

ETA: Good work to the tow truck driver, I hope he wasn't freelancing for compensation. Can the tow truck take the van w/o a complaint? Can't the driver, upon seeing the infraction, be the complainant?

My mailman (over 20 yrs. service) says the USPS has never instructed the carriers what to do except not to park in a handicap space or a red zone and if they get a ticket, it's the driver's responsibility, no reimb. from USPS. He said the local cops have told him they will issue a ticket for the offense.

My mailman raises an interesting wrinkle. The tow truck has just stolen the mail and that's a Federal Crime.

Guess we'll need some legal advice. Nothing is ever black and white.

Some interesting points, Bob. Any companies I have known tell their drivers they are responsible .............. so you would think it would be the individual letter carriers (the driver's responsibility). As it is a Federal Law (offense) to park in a Disabled space and it is the tow truck driver's job to remove the vehicle ........... it leaves a very unclear situation. I would think it is NOT necessary for a complaint if it is a commercial, public place. Different if it is a private residence perhaps. I have heard this said before but if it is public then it grays the situation IMO.

Why should the postal driver be able to park there 'cause she/he had to go....................please, can they not wet themselves just like has happened to us in the same circumstances?

The Postal employee IS responsible for the ticket, so she must have REALLY had to go to risk a minimum (not sure anymore) $250 ticket.

If it was at a MickeyD's it is on private property, different from an onstreet parking space. We don't know if that franchisee might have a standing order to tow w/o further instructions, probably not, but a possibility, especially if the franchisee didn't want to decide on a case by case basis.

the towing company probably gets a commision per tow, or thats how they make money, per tow

the question is simple, are they or anyone above the law?

if u say no, then ask yourself 1 question.......

if a cop car parks in a handicap spot, are they guilty?

what if the cop did it in association with a crime?

if u say no, what if cop car was just to get donuts?

to me tho, the mail carrier is guilty!

but if i were judge id dismiss ticket with instructions to post office head honchos to have staff meeting on topic

Why don't we just get rid of handicapped parking places? What the hey? Those 2 parking places in front of businesses were always open before they were designated with the blue wheelchair silhouettes, right? I mean, we can find another place or 2 places that allow our ramps and lifts to deploy, right?
I think I wrote about what our town used to do with the snow they removed from sidewalks. They piled it up on the only 2 HP parking places in front of the courthouse.
A few years ago, I was called for jury duty and I had to ask a couple of city employees if they could please move their municipal truck so that I could use the only other open HP parking place. The other spot was being used by a very able-bodied judge. Nice place, huh?

Nona, we may as well get rid of them (disabled parking spaces) because the abuse is so rampant, no one seems to care ( I see no young disabled taking up the cause), most anybody can get a tag, AND of course every Tom, Dick, and Harry "KNOWS" they are entitled.

Lola, wait till you get to my age, lol I am completely "fed up to the gills" with all the excuses and BS these morons tell you. AND ............... if it were number 2 business ...............GREAT.........I hope they messed up so to speak. Now they have a very small taste of what we live with on a daily bases.

roadrunner, i swear...i have been a downer on you for all your past rants...but i did the same thing to this one lady who parked in the stripes about a month ago on me and i had to tweak my body and chair to get it into my car. so i pulled my car out when i got in, finally, my back was already screaming in pain, and i sat behind her tail-end until she came out. We had a loooooooooong conversation. More like the RANT FROM HELL and now...like a month later I STILL feel badly for her.

I told my sis that she took the rap for ALL those in the past that i never screamed at. (and i've given a fair share of mine...but still)----you know, she reminded me of my sis too cus she seemed to want to let me just rant...real quiet, smiled, and i could feel that she had a big heart, like my sis, but when all was done, she said "well, my temp placard is really my husbands, and it is going to expire in a couple of weeks, so i won't be using it anymore." ---------she had a big blue soft-cover footwrap on one side, not limping but that was her problem...no crutch or such. I got why she parked there, but it WAS in the STRIPES. idiot...she could have just parked one over. seriously...lots of spaces available. i told her to educate the next person, if she saw them park in the stripes. I Also------thought of you! lol I'm 53 now. [ don't know if you will appreciate this ..but, at one point she started moving on me like she was going to her car....and I started up again, LMBO...and told her I wasn't through yet]

Aevory, you know girl that's life, LOL. I never understood the statement, "You don't know till you've been there." My, Mom, bless her heart, never understood either until she has a stroke incompletely paralyzing her left side. Then I understood.

When I was a young, agile quad I could manage some of these "moves". At 72 it's not only an inconvenience it makes life very difficult as you know. By the time I drag myself out of bed in the a.m. I have no patience left for ignorant morons. To be very frank it P me off no end that I should have to educate someone on parking issues they are supposed to know before they get a driver's license. I always ask them if they park in firelanes too. Feel bad, yeh sometimes I do. I wish they would invent an instant zapper............. See that little pile of dust........it used to be an improperly parked vehicle?

Just a quick note from Enforcement Tow, the company who did this... YES we are allowed to verify our own tows. We have to take pictures documenting the violation, which we did. This tow is completely justified and LEGAL!

NO, the USPS is NTO allowed to park in the H-CAP and I have a letter from the Post Master General stating this.

We are contracted and the appropriate signs are posted warning violators of the towing!
